1. Agreement and Acceptance

These Terms & Conditions (the “Terms”) govern your access to and use of the mobile application Bible Chat - Inner Peace (the “App”), the optional premium subscription Bible Chat Plus, and related websites or support pages at github.com/ttimocin/bible-chat-inner-peace-web (collectively, the “Services”), operated by Taygun Timocin (“we,” “us,” or “our”).

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

IF YOU DO NOT AGREE TO THESE TERMS, OR IF YOU DO NOT HAVE THE LEGAL CAPACITY TO ENTER INTO THEM, YOU MUST NOT USE THE SERVICES.

2. Description of Services

Bible Chat - Inner Peace is a digital tool for private spiritual reflection. The Services may include, without limitation:

AI-assisted conversations for devotional reflection and Scripture-based encouragement;
Display of Bible verses from the Almeida translation (Portuguese);
Emotion- and topic-based guided prompts;
Daily reflections, prayers, and reading features (as available in your version of the App);
Optional premium features under Bible Chat Plus.

Not professional advice: The Services are for informational and devotional purposes only. They do not constitute medical, psychological, psychiatric, legal, or pastoral counselling, diagnosis, or treatment. The AI companion is not a clergy member, therapist, or healthcare provider. Always seek qualified professional help for health, mental health, legal, or pastoral matters.

The Services include artificial intelligence generated content. AI responses may be inaccurate, incomplete, or inappropriate. We do not guarantee theological correctness or factual accuracy of AI outputs.

3. Eligibility

You must be at least 16 years old to use the Services, or the age of digital consent in your jurisdiction if higher. If you are under 18 (or the age of majority where you live), you represent that you have permission from a parent or legal guardian.

By using the Services, you represent and warrant that: (a) you have the legal capacity to enter into a binding agreement; (b) you are not barred from using the Services under applicable law; and (c) all information you provide is truthful and accurate to the best of your knowledge.

4. Account and Anonymous Use

The App may assign an anonymous technical identifier (UUID) for authentication through our infrastructure provider (Supabase). You may optionally link a Google or Apple account when that feature is available.

You are responsible for: (a) maintaining the security of your device and any linked accounts; (b) all activity that occurs through your use of the Services on your device; and (c) keeping optional profile information accurate.

Local storage: Chat history is stored on your device. We do not maintain a permanent, user-facing chat archive on our servers. You may delete local data through App settings. Uninstalling the App may remove locally stored data depending on your device settings.

5. Subscriptions (Bible Chat Plus)

5.1 Premium features

Certain features require a paid subscription (“Bible Chat Plus”). Subscription options, prices, and included features are displayed in the App and may vary by region and store.

5.2 Billing

Purchases are processed by the Apple App Store or Google Play Store, or through RevenueCat as a subscription management layer. Payment is charged to your store account. We do not collect or store your full payment card details.

5.3 Free trials and auto-renewal

If a free trial is offered, you will be charged when the trial ends unless you cancel at least 24 hours before the trial expires. Subscriptions automatically renew at the end of each billing period (e.g., weekly, monthly, or annual) unless you cancel at least 24 hours before renewal through your store account settings or as indicated in the App.

5.4 Cancellation and refunds

You may cancel a subscription at any time through your Apple or Google account settings. Cancellation stops future charges; access typically continues until the end of the current paid period.

Refunds are governed by the policies of Apple, Google, and applicable consumer law. We do not guarantee refunds beyond what your store or mandatory law provides. For the United States, Brazil, and Mexico, mandatory withdrawal or cooling-off rights may apply to digital purchases as provided by law and store policies.

5.5 Price changes

We may change subscription prices. Where required, your store or we will notify you and obtain your consent before charging a new price. If you do not agree, cancel before the next billing cycle.

6. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use during your subscription term (if applicable).

You may not:

Copy, modify, distribute, sell, or lease any part of the Services;
Reverse engineer, decompile, or attempt to extract source code except as permitted by law;
Use the Services to develop a competing product or service;
Scrape, crawl, or systematically extract data or AI outputs;
Remove proprietary notices or misrepresent ownership of the Services.

All rights not expressly granted are reserved. The Services and all related intellectual property remain our property or that of our licensors.

7. User Content and AI Outputs

7.1 Your inputs

You retain ownership of messages and other content you submit through the Services (“User Content”). You are solely responsible for User Content and must have all rights necessary to submit it.

7.2 License to us

You grant us a limited, non-exclusive, worldwide, royalty-free license to use, process, and transmit User Content solely to: (a) provide and operate the Services; (b) generate AI responses; (c) maintain security and prevent abuse; and (d) comply with law. This license ends when User Content is deleted from our systems, subject to backup and legal retention limits.

We do not claim a broad, perpetual license to use your User Content to train general-purpose AI models for unrelated products. Processing is limited to delivering the Services described here.

7.3 AI outputs

Responses generated by the Services (“Outputs”) are provided for your personal devotional use. Outputs may not be unique and may be similar to content provided to other users. We do not assign exclusive rights in Outputs. You may not present Outputs as professional advice or as official religious teaching.

7.4 Monitoring

We are not obligated to monitor User Content but may remove or restrict access to content or suspend use where we reasonably believe it violates these Terms, applicable law, or poses a safety risk.

8. Third-Party Services

The Services integrate with or rely on third parties, including Microsoft Azure OpenAI, Supabase, RevenueCat, Apple, Google, and text-to-speech providers. Your use of those services may be subject to separate terms and privacy policies.

We are not responsible for third-party services, their availability, or their acts or omissions. Links or integrations do not constitute endorsement.

9. Acceptable Use

You agree not to use the Services to:

Violate any applicable law or regulation;
Harass, threaten, defame, or harm others;
Submit content that is unlawful, obscene, hateful, exploitative, or infringes third-party rights;
Impersonate any person or misrepresent your affiliation;
Transmit malware or attempt to disrupt the Services;
Circumvent access controls, usage limits, or subscription requirements;
Record, republish, or commercially exploit Outputs without permission;
Use the Services for automated scraping, benchmarking, or competitive analysis without our written consent;
Seek emergency services through the App instead of contacting local emergency numbers directly.

We may suspend or terminate access immediately if we believe you have violated these rules or pose a risk to the Services or others.

10. Assumption of Risk

You use the Services at your own risk. You are solely responsible for decisions you make based on App content or AI Outputs, including spiritual, emotional, or practical decisions.

If you experience emotional distress, mental health concerns, or a medical emergency, do not rely on the App. Contact qualified professionals or emergency services immediately:

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT (INCLUDING AI OUTPUTS AND BIBLE VERSES PRESENTED IN THE APP) ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR THEOLOGICALLY SOUND.

NO ORAL OR WRITTEN INFORMATION FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow exclusion of certain warranties; in those cases, our disclaimers apply to the fullest extent permitted.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAYGUN TIMOCIN OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Nothing in these Terms limits liability where limitation is prohibited by mandatory law (including liability for death or personal injury caused by negligence, fraud, or intentional misconduct where such limitation is not permitted).

You acknowledge that the fees charged (if any) reflect this allocation of risk.

13. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Taygun Timocin and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Services; (c) your violation of these Terms or applicable law; (d) your violation of third-party rights; or (e) any dispute between you and a third party in connection with the Services.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you violated these Terms, applicable law, or pose a security or safety risk.

You may stop using the Services at any time. You may cancel subscriptions through your store account. Upon termination, your license to use the Services ends immediately. Sections that by nature should survive (including disclaimers, limitation of liability, indemnity, and governing law) will survive.

We may modify or discontinue the Services or any feature at our discretion. Where required by law, we will provide reasonable notice of material changes that affect paid subscriptions.

15. Intellectual Property

The App name, logos, design, software, and original content (excluding User Content and third-party Bible text) are protected by copyright, trademark, and other laws. Almeida Bible text remains subject to applicable copyright and licensing for that translation.

You may not use our trademarks or branding without prior written permission.

16. Copyright / DMCA

If you believe content in the Services infringes your copyright under U.S. law, send a notice to taytekofficial@gmail.com with:

Your physical or electronic signature;
Identification of the copyrighted work;
Identification of the material claimed to be infringing and its location;
Your contact information;
A statement of good-faith belief that use is not authorized; and
A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

We may remove or disable access to material alleged to be infringing and may terminate repeat infringers where appropriate.

17. Regional Terms

17.1 Brazil

If you are a consumer in Brazil, the Código de Defesa do Consumidor (CDC) and LGPD apply where mandatory. Nothing in these Terms limits non-waivable consumer rights. You may contact us in Portuguese at taytekofficial@gmail.com. Privacy rights are described in our Privacy Policy.

17.2 Mexico

If you are a consumer in Mexico, the Ley Federal de Protección al Consumidor and LFPDPPP may grant you mandatory rights regarding advertising, billing clarity, and personal data. You may contact PROFECO for consumer information. Privacy requests (ARCO) may be sent to taytekofficial@gmail.com. We will respond in accordance with applicable Mexican law.

17.3 United States

To the extent permitted by applicable law, you and we agree that disputes will be resolved on an individual basis only, and not as a class, collective, or representative action. You waive any right to a jury trial where such waiver is enforceable. This does not apply where prohibited by mandatory state or federal law.

California residents may contact us regarding privacy rights as described in the Privacy Policy.

18. Governing Law and Disputes

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence require otherwise.

Before initiating formal proceedings, you agree to contact us at taytekofficial@gmail.com and attempt to resolve the dispute amicably for at least ninety (90) days.

Subject to mandatory consumer rights, the courts of Hamburg, Germany shall have jurisdiction where permitted. If you are a consumer in the United States, Mexico, or Brazil, you may also bring proceedings in the courts of your country of residence where required by mandatory local law.

Any claim must be brought within one (1) year after the basis for the claim became known, except where a longer period is required by mandatory law.

19. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App, by email if available, or by posting updated Terms at github.com/ttimocin/bible-chat-inner-peace-web at least 30 days before they take effect where feasible.

Your continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, you must stop using the Services and cancel any subscription.

20. General

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Services.
Severability: If any provision is invalid, the remainder stays in effect.
No waiver: Failure to enforce a provision is not a waiver.
Assignment: We may assign these Terms; you may not assign them without our consent.
Force majeure: We are not liable for delays or failures due to events beyond reasonable control.
Language: These Terms are written in English. Translations are for convenience only; the English version controls to the extent permitted.

By using the Services, you confirm that you have read these Terms, including sections on disclaimers, limitation of liability, indemnification, acceptable use, and governing law, and that you accept them.
